Terms of Service

These terms govern the photo booth hire services provided by RMD Booth Co ("we", "us", "our"). By booking our services or using our website, you agree to these terms. These terms are subject to Australian Consumer Law, and nothing in these terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law.

1. Services

RMD Booth Co provides premium photo booth hire services for events including weddings, corporate functions, and private parties in Perth and Western Australia. Our services include:

  • Photo booth equipment setup and operation
  • Dedicated on-site attendant for the duration of hire
  • Unlimited instant prints during the hire period
  • Custom print template design
  • Props collection
  • Online photo gallery for guests
  • Digital copies of all photos

2. Bookings and Payment

Booking Confirmation

A booking is confirmed once we have received a signed booking agreement and the required deposit. Until both are received, your date is not secured.

Deposit

A non-refundable deposit of 25% of the total booking amount is required to secure your date. The deposit is deducted from the total amount due.

Final Payment

The remaining balance is due 14 days before the event date. If the booking is made less than 14 days before the event, full payment is required at the time of booking.

Pricing

  • All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable
  • Additional hours beyond the booked package can be added at $200 per hour, subject to availability
  • Travel surcharges may apply for events outside the Perth metropolitan area

3. Cancellation and Refunds

Cancellation by You

  • More than 30 days before the event: The deposit is forfeited but no further payment is due. If final payment has been made, the balance (excluding the deposit) will be refunded.
  • 14 to 30 days before the event: 50% of the total booking amount is due.
  • Less than 14 days before the event: The full booking amount is due and non-refundable.

Date Changes

We will do our best to accommodate date changes, subject to availability. Date changes requested more than 30 days before the original event date incur no additional fee. Changes within 30 days may incur a $100 rescheduling fee.

Cancellation by Us

In the unlikely event that we need to cancel (due to equipment failure, illness, or circumstances beyond our control), we will offer a full refund of all payments made or an alternative date at no extra charge.

4. Event Day Requirements

  • A clear, flat area of approximately 2m x 2m is required for the booth setup
  • Access to a standard power outlet within 5 metres of the booth location
  • We require access to the venue at least 60 minutes before the booth hire start time for setup
  • The booth must be in a sheltered, indoor or covered area (the equipment cannot be exposed to rain or extreme weather)

5. Equipment and Damage

Our equipment is professionally maintained and insured. However, the client is responsible for any damage to equipment caused by guests or attendees during the event that is the result of negligence, misuse, or deliberate actions. This includes but is not limited to:

  • Physical damage to the booth, screen, or camera
  • Spillage of food or drinks on equipment
  • Damage caused by moving the equipment without authorisation

If damage occurs, the client will be invoiced for the cost of repair or replacement. Our attendant is present throughout the hire to supervise the equipment and minimise risk.

6. Photos and Intellectual Property

Your Photos

All photos taken during your event are yours. We provide digital copies via an online gallery link sent after the event. Galleries are available for 12 months.

Portfolio Use

We may use photos from your event for our portfolio, website, and social media unless you notify us in writing before the event that you do not consent. No photos will identify individuals by name without explicit permission.

7. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the total fees paid for the booking in question.

We are not liable for any indirect, incidental, special, or consequential damages, including loss of enjoyment or emotional distress.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

8. Force Majeure

Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, severe weather, government restrictions, pandemic, or other force majeure events. In such cases, we will work with you to reschedule or provide a full refund.

9. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve it through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue mediation before initiating legal proceedings.

11. Governing Law

These terms are governed by the laws of Western Australia and the Commonwealth of Australia. Both parties submit to the exclusive jurisdiction of the courts of Western Australia.

12. Changes to These Terms

We may update these terms from time to time. Any changes will be posted on this page with an updated "Last updated" date.
